Dutch systems developer QI Press Controls says it has won the first round in its defence against US court action by rival Quad/Tech.
On April 1, the United States District Court for the Eastern District of Pennsylvania ruled in favour of QIPC and denied the Motion for Preliminary Injunction brought by Quad/Tech. This alleged that the QIPC register control system sold in the United States under the mRC label – the mRC+ with micro marks – infringed Quad/Tech US patent 5,412,577. The court ruled in QIPC's favour and against Quad/Tech in all respects.
The order also denied Quad/Tech's many recently filed motions, including a motion in which Quad/Tech sought the court's permission to add to its complaint claims that the IDS (Intelligent Density System) and IRS (Intelligent Register System, which also uses registration marks)) allegedly infringed the patent at issue.
QIPC chairman Menno Jansen says the company is “extremely happy” with the ruling which it believes is the first step to total vindication in the lawsuit.
