‘Easy-cancel’ subs code into force this month

New rules that allow subscribers in France to cancel “in a few clicks” are effective this month following their adoption in June.

Businesses must offer consumers the online termination functionalities after a decree introduced new provisions into the consumer code including a ‘terminate your contract’ button.

It requires a termination functionality on websites or mobile applications, including a form allowing consumers to enter relevant termination information, check and confirm it, with a requirement that a notification of termination must be sent.

Additional information on the notice period, potential termination indemnity if applicable and/or the consequences of cancellation may also be provided.

There are also circumstances under which specific conditions to be tied to the consumer where there are “legitimate reasons” such as debts, dismissal, force majeure or moving abroad. While the new rules apply to contracts already in force at June 1, 2023, traders were given until September 1 to comply.

A new EU directive also proposes a “visible and comprehensible” withdrawal button during a two-week period.
